Americans With Disabilities Act (ADA)

The Americans with Disabilities Act of 1990 (ADA) prohibits discrimination and ensures equal opportunity for persons with disabilities in employment, State and local government services, public accommodations, commercial facilities, and transportation.

Alternative Formats

A public entity shall take appropriate steps to ensure that communications with applicants, participants, and members of the public with disabilities are as effective as communications with others. Appropriate auxiliary aids and services need to be provided where necessary to afford an individual with a disability an equal opportunity to participate in, and enjoy the benefits of, a service, program, or activity conducted by a public entity.

The type of auxiliary aid and service is determined by giving primary consideration to the requests of the individual with a disability. “Auxiliary aids” include such services or devices as qualified interpreters, assistive listening headsets, real time, open, closed captioning, teletypewriters (TTY) or Telecommunications Relay services (TRS), video text displays, readers, taped texts, Braille materials, and large print materials.

Although compliance may result in additional cost, a public entity may not place a surcharge to particular individuals or groups with disabilities to cover the expense. A surcharge may arise as a result of any component of a public entity’s programs, services, and activities.

ADA Coordinator

The ADA calls for every public entity that employs 50 or more persons to designate at least one employee to coordinate its efforts to comply with and carry out its responsibilities under the ADA (Regulation §35.107). The State entity must make the name, office address, and telephone number of the ADA Coordinator readily available to all interested individuals.
